MARS Compliant Shortsale Marketing
We have received many questions over the last couple of weeks regarding the new MARS (Mortgage Assistance Relief Services) Ruling passed by the FTC to protect consumers and curb unfair and deceptive practices associated with mortgage assistance relief services. Information regarding this law can be found on the FTC Website.
The new ruling states that Real Estate Professionals can be fined $11,000 if they do not use the disclosures on marketing materials related to helping homeowners in "distressed" situations. Though the ruling indicates "Mortgage", the rule applies to real estate agents soliciting business for Short Sales or "Distressed Property".
Beginning March 1, 2011 PrinterBees will print the disclosure on all short sale marketing products. The disclosure that PrinterBees will print on all Short Sale related marketing pieces is:
"(Name of company) is not associated with the government, and our service is not approved by the government or your lender." "Even if you accept this offer and use our service, your lender may not agree to change your loan."
Please contact PrinterBees regarding printing questions. Contact your attorney, the FTC or your local Real Estate Board for legal advice on how to make sure you are compliant. PrinterBees is not qualified to give legal advice regarding real estate rules and regulations.
